Analysis of output-oriented responsibilities of judicial institutions developed by EUROL 3 expert

Between December 2022 and February 2023, Mr. Gualtiero Michelini, Judge of the Supreme Court of Italy, developed an Analysis of output-oriented responsibilities of judicial institutions with recommendations for the improvement of work efficiency, referring also to the World Bank recommendations in this area.

In performing his task, Mr. Michelini reviewed all necessary legislation and material received from the project team, including the World Bank document, the latest progress reports, relevant reports of MNE judicial institutions, and relevant laws. Within the second part of the mission which took place between 23 and 27 January 2023, the expert met representatives of the Ministry of Justice, the Supreme Court of Montenegro, the Appellate Court, the Basic Court Podgorica, the Judicial Council, the Supreme State Prosecutor’s Office, the Prosecutorial Council, and the Special State Prosecutor’s Office, and discussed the main recommendations from the World Bank Report related to the functioning of the judiciary in Montenegro, to check the current situation in all covered areas.

Following the desk research and the conducted interviews, the expert delivered the Analysis on output-oriented responsibilities of judicial institutions, which provided an overview and some general recommendations for the situation in the Montenegrin judiciary related to governance and management, efficiency and effectiveness of justice services, quality of justice and access to justice services, financial resources, human resources, IT, and infrastructure management.

The Analysis has been delivered to the Ministry of Justice for review and is considered to be the initial phase of the EUROL 3 support to the Ministry of Justice in the development of the new Strategy for the Reform of the Judiciary 2024 – 2027.
