As part of the overarching support to Chapters 23 and 24 component of EUROL 3, the project team organized a two-day Round Table on the Draft Law on Confiscation on 11 and 12 July 2022, in the premises of the EU Delegation.
The Round Table was preceded by a preparatory meeting which took place on 27 June 2022. The purpose of the meeting was to present the status quo concerning the (Draft) Law on Seizure and Confiscation, present the identified main issues of the (Draft) Law on Seizure and Confiscation and their potential solutions, and develop the agenda for the workshop on 11 and 12 July 2022.
EUROL 3 contracted two international experts (Mr. Maurizio Varanese, a Chief Inspector at the Investigative Department of Carabinieri in Rome and Mr. Theo Byl, Investigation Judge and President of the Mechelen District Court). The experts were already tasked with reviewing the Draft Law on Amendments to the Law on Seizure and Confiscation of Assets Derived from Criminal Activities in the inception phase of the project.
The Round Table of 11 and 12 July gathered representatives of the EU Delegation, the MNE Ministry of Justice, Montenegrin experts, EUROL 3 Experts, and an expert from the CoE. Together with the international experts, the participants analysed the Draft Law Article by Article in order to develop the concept for its revision. Based on the discussion, the experts developed a Report with concrete recommendations on how to amend and improve the Draft Law.
